1. Overview
This website located at nursewellversed.com (the “Site”), together with our online store, digital products, courses, and related services offered by Nurse Well Versed (“Nurse Well Versed,” “we,” “us,” or “our”), are collectively referred to as the “Services.” These Terms and Conditions (the “Terms”) govern your access to and use of the Site and the Services, including purchases made through the Site or through our storefront on Shopify. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
Please also review our Privacy Policy, which explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference.
2. Acceptance of Terms
By creating an account, placing an order, submitting a review, or otherwise using the Services, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time as described in Section 17 (Changes to Terms). Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
Visiting the Site or sending us electronic communications, including emails, constitutes electronic communication. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
3. Eligibility & Accounts
3.1 Age Requirements. You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or otherwise enter into these Terms. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
3.2 Children’s Privacy. Nurse Well Versed does not knowingly collect personal information from children under 13 in accordance with the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly.
3.3 Accounts. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information or that we reasonably believe are being used in violation of these Terms.
3.4 Professional Status. Some Services are intended for nursing students, nurses, and other healthcare professionals or aspiring professionals. Nothing in these Terms verifies or certifies your professional credentials, licensure, or eligibility to practice; that remains your sole responsibility, as further addressed in Section 12 (Educational Disclaimer).
4. Products & Services
Nurse Well Versed offers a variety of products and services, which may include physical merchandise sold through our Shopify-powered store, digital products (such as study guides, templates, printables, and online courses), memberships, and educational content (collectively, the “Products”). Product descriptions, images, and pricing are provided for informational purposes and are subject to change without notice. We make reasonable efforts to display Products and their features, pricing, and availability accurately, but we do not warrant that all information is complete, current, or error-free, and we reserve the right to correct any errors, inaccuracies, or omissions and to cancel or refuse orders arising from such errors, even after an order has been submitted or confirmed. We reserve the right to modify, discontinue, replace, or limit the availability of any Product or Service at any time without notice. Product descriptions, images, specifications, pricing, and availability are subject to change.
5. Digital Products & License
5.1 License Grant. When you purchase a digital Product (including PDFs, templates, worksheets, guides, videos, and online courses), we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use that digital Product for your own personal, non-commercial, educational use.
5.2 Restrictions. You may not: (a) copy, reproduce, distribute, resell, rent, lease, sublicense, or share digital Products with any third party, including via file-sharing, cloud drives, or social media; (b) remove or alter any copyright, trademark, or proprietary notices; (c) reverse engineer, decompile, or create derivative works from any digital Product; or (d) use any digital Product for commercial purposes, including training or coaching others or resale, without our prior written consent. Customers may print Digital Products solely for their own personal educational use. Printed copies may not be sold, distributed, shared, or reproduced for others.
5.3 Delivery & Access. Digital Products are typically delivered by download link, email, or access to a member portal. You are responsible for maintaining your own copies and for ensuring you have compatible devices and software to access digital Products. We are not responsible for your failure to download or access a digital Product within any applicable access window. Access to digital products may be suspended or revoked if you violate these Terms.
5.4 No Ownership Transfer. Purchasing a digital Product does not transfer ownership of the underlying content. All intellectual property rights remain with Nurse Well Versed or its licensors, as described in Section 9 (Intellectual Property).
5.5 Lifetime Access. Where a Product is described as providing “lifetime access,” this means access for the commercial lifetime of that Product as offered by Nurse Well Versed. We reserve the right to modify, replace, discontinue, migrate, or retire Products, platforms, features, or supporting services. If a Product is discontinued, we may, at our discretion, provide access to substantially similar content where reasonably practicable.
6. Orders & Payment
6.1 Order Acceptance. Your order is an offer to purchase a Product. We reserve the right to accept or decline any order, in whole or in part, for any reason, including suspected fraud, pricing errors, or unavailability of a Product. If we cancel an order after payment has been collected, we will issue a refund for the canceled portion.
6.2 Pricing & Taxes. All prices are listed in U.S. dollars unless otherwise stated and are subject to change without notice. You are responsible for any applicable sales tax, use tax, customs duties, or other charges, which will be calculated and disclosed at checkout where required by law.
6.3 Payment Processing. Payments are processed through Shopify and its third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processors) to charge the applicable amount, including taxes and shipping, to that payment method. We do not store your full payment card information; it is handled directly by our payment processors in accordance with their own terms and applicable data security standards, such as PCI-DSS.
6.4 Promotions & Discounts. Promotional offers, discounts, coupons, flash sales, and limited-time offers are subject to change or cancellation without notice. Unless expressly stated otherwise, promotions may not be combined, applied retroactively, redeemed for cash, or transferred to another person.
6.5 Errors. If a Product is mistakenly listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel any order placed for that Product, whether or not the order has been confirmed and your payment method charged. We reserve the right to correct pricing, product descriptions, images, availability, or other typographical or technical errors and to cancel or refuse any affected order prior to shipment or fulfillment.
6.6 Payment Disputes. Customers agree to contact Nurse Well Versed before initiating a payment dispute or chargeback so we have an opportunity to resolve the issue. Initiating a chargeback after receiving a refund, replacement, or other agreed resolution may result in cancellation of future orders or other appropriate action where permitted by law. We reserve the right to provide documentation related to your order to the payment processor or financial institution during any dispute investigation.
7. Shipping
7.1 Physical Products. For orders that include physical merchandise, we will provide an estimated shipping or delivery timeframe at checkout or in your order confirmation. Shipping times are estimates only and are not guaranteed. Title and risk of loss for physical Products pass to you upon delivery to the shipping carrier.
7.2 Delays. We are not responsible for delays caused by the shipping carrier, customs processing, weather, or other events outside our reasonable control. Consistent with FTC mail, internet, and telephone order rules, if we are unable to ship your order within the timeframe stated at checkout (or within 30 days if none is stated), we will notify you and provide the option to consent to a delay or cancel your order for a full refund.
7.3 International Orders. If we ship internationally, you are responsible for any customs duties, import taxes, or other fees imposed by your country. We are not responsible for delays caused by customs processing.
7.4 Digital Products. This Section 7 does not apply to digital Products, which are delivered electronically as described in Section 5.3.
7.5 Shipping Address Accuracy. Customers are responsible for providing a complete and accurate shipping address at checkout. Please carefully review your shipping information before placing your order. Nurse Well Versed is not responsible for delays, failed deliveries, lost packages, or additional shipping charges resulting from an incorrect, incomplete, or outdated shipping address provided by the customer. If you notice an error in your shipping address, please contact us immediately. While we will make reasonable efforts to update your order before it is processed, we cannot guarantee that address changes can be made once an order has entered fulfillment or has been shipped.
7.6 Returned or Undeliverable Packages. If an order is returned to Nurse Well Versed due to an incorrect or undeliverable address provided by the customer, the customer may be responsible for any applicable reshipping charges before the order can be shipped again.
8. Returns & Refunds
8.1 Physical Products Purchased from NurseWellVersed.com. Physical products purchased directly from Nurse Well Versed may be returned within 14 days of delivery, provided they are returned in their original condition. Customers are responsible for return shipping costs and may be subject to a restocking fee of up to 7%, unless the return is the result of our error or a verified manufacturing defect.
Once the returned item is received, please allow 5–10 business days for us to inspect and process your return. If the return is approved, a refund will be issued to the original payment method. After the refund has been processed, your financial institution may require additional time to post the refund to your account.
Certain products, digital products, or promotional items may not be eligible for return where prohibited by law or as otherwise stated at the time of purchase.
8.2 Digital Products. Due to the immediate nature of digital access, all digital product sales are final and non-refundable, except where required by applicable law. If you experience technical issues accessing your purchase, please contact us. We will make reasonable efforts to help you access the product you purchased.
8.3 Damaged, Defective, or Incorrect Items. If your order arrives damaged, defective, or you receive the wrong item, please contact us within 7 days of delivery.
We may request photographs of:
- the product,
- the packaging,
- and the shipping label
to assist in evaluating the issue. At our discretion, we may provide a replacement, refund, store credit, or another appropriate resolution.
8.4 Orders Placed Through Third-Party Marketplaces. Orders placed through third-party marketplaces (including TikTok Shop, Etsy, Amazon, or other retailers) are subject to the return, refund, and buyer protection policies of that marketplace. While we are happy to assist when possible, purchases made through third-party platforms must generally be resolved through the platform where the order was placed.
8.5 Shipping Charges. Shipping charges are non-refundable except where required by law or when a refund is issued due to an error made by Nurse Well Versed.
9. Intellectual Property
All content on the Site and included in the Products — including text, graphics, logos, images, course materials, video, audio, software, and the compilation and arrangement of the foregoing (the “Content”) — is the property of Nurse Well Versed or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 5, nothing in these Terms grants you any right, title, or interest in any Content, and all rights not expressly granted are reserved.
You may not reproduce, modify, distribute, publicly display, publicly perform, republish, or create derivative works from any Content without our prior written permission, except as permitted by applicable law (such as fair use) or as expressly authorized by these Terms.
10. User Reviews & User-Generated Content
10.1 Submissions. If you submit a product review, testimonial, comment, photo, video, or other content to us or through the Site, our social media accounts, or third-party review platforms (collectively, “User Content”), you represent that the User Content is your own original work, is truthful and reflects your genuine experience, and does not infringe any third party’s rights or violate any law.
10.2 License Grant – Reviews Are Ours to Use. By submitting User Content, including any public product review, you grant Nurse Well Versed a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, edit, adapt, translate, publish, publicly display, publicly perform, and distribute that User Content, in whole or in part, in any format or medium now known or later developed, for any purpose, including marketing, advertising, packaging, and promotional materials — without further notice, compensation, or attribution to you, except where attribution is required by applicable law or where you have specifically requested anonymity and we have agreed in writing. In short: if you leave us a public review, we may use it.
10.3 No Obligation to Use or Monitor. We are under no obligation to post, display, or use any User Content, and we may remove or decline to publish any User Content at our sole discretion, including reviews we determine are fraudulent, abusive, off-topic, or otherwise in violation of these Terms. We do not pay for reviews, and we do not manipulate reviews by suppressing genuine negative reviews or fabricating positive ones, consistent with the FTC’s rules concerning reviews and testimonials.
10.4 Your Responsibility. You are solely responsible for the User Content you submit. We do not guarantee the accuracy of User Content submitted by others and are not liable for any reliance placed on it.
11. Prohibited Uses
You agree not to use the Services to:
- Violate any applicable law or regulation;
- Infringe the intellectual property, privacy, or publicity rights of others;
- Transmit any harassing, defamatory, obscene, fraudulent, or otherwise objectionable material;
- Upload viruses or malicious code, or attempt to interfere with the security or proper functioning of the Site;
- Scrape, harvest, or collect information about other users without consent;
- Resell or redistribute any Product without our written authorization;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity; or
- Attempt to gain unauthorized access to any portion of the Services, other accounts, or related systems or networks.
- Abuse referral programs, affiliate programs, promotional discounts, coupons, giveaways, or other promotional offers, including self-referrals or other fraudulent activity.
We reserve the right to investigate and take appropriate action, including suspending or terminating your account and/or reporting conduct to law enforcement, against anyone who violates this Section.
12. Educational Disclaimer (Not Medical Advice)
12.1 Educational Purposes Only. All content, Products, and Services provided by Nurse Well Versed — including study guides, courses, videos, and other materials — are intended for general educational and informational purposes only, designed to support nursing students and nursing professionals in their studies and professional development.
12.2 Not Medical Advice. Nothing on the Site or in any Product constitutes, or should be relied upon as, medical advice, nursing advice, clinical guidance, or a substitute for professional medical judgment, accredited nursing education, clinical supervision, or licensure exam preparation provided by an accredited institution. Always follow the policies, protocols, and instructions of your school, clinical instructors, employer, and licensing board, and consult qualified professionals regarding specific patient care, medical, or clinical decisions.
12.3 No Guarantee of Results. We do not guarantee that use of any Product will result in passing any examination (including the NCLEX), admission to or successful completion of any academic program, licensure, or employment. Any examples, testimonials, or results referenced on the Site are illustrative only, and individual results vary based on numerous factors outside our control.
12.4 Your Responsibility. You are solely responsible for verifying the accuracy and applicability of any information against current, authoritative, jurisdiction-specific sources (such as your nursing program, clinical site, employer, and state board of nursing) before relying on it in an academic, clinical, or professional setting.
13. Third-Party Services
The Site may contain links to third-party websites, plug-ins, or services (“Third-Party Services”), including payment processors, shipping carriers, and social media platforms. We do not control and are not responsible for the content, privacy practices, or terms of any Third-Party Service, and inclusion of a link does not imply our endorsement. Your use of any Third-Party Service is subject to that third party’s own terms and privacy policy, and you access it at your own risk.
14. Limitation of Liability
14.1 “As Is” Basis. The Services and all Products are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Nurse Well Versed disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
14.2 Limitation. To the maximum extent permitted by applicable law, in no event will Nurse Well Versed, its officers, directors, employees, contractors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Services, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
14.3 Cap on Liability. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the amount you paid to Nurse Well Versed for the Product(s) giving rise to the claim in the twelve (12) months preceding the event giving rise to liability.
14.4 Exceptions. Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you. Nothing in this Section 14 is intended to limit any liability that cannot be excluded or limited under applicable consumer protection law, including the New Jersey Consumer Fraud Act, or to limit your rights as a consumer under the law of your state of residence.
15. Indemnification
You agree to defend, indemnify, and hold harmless Nurse Well Versed and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third party’s rights, including intellectual property or privacy rights; or (d) any User Content you submit. This obligation survives termination of these Terms and your use of the Services.
16. Governing Law
16.1 Governing Law. These Terms, and any dispute arising out of or related to them or the Services, are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles and without regard to the United Nations Convention on Contracts for the International Sale of Goods.
16.2 Informal Resolution. Before filing a claim against Nurse Well Versed, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days. We agree to do the same before pursuing a claim against you. Most disputes can be resolved this way.
16.3 Binding Arbitration. If a dispute is not resolved informally, you and Nurse Well Versed agree that it will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, rather than in court, except as set forth in Section 16.5. The arbitration will be conducted in New Jersey or another mutually agreed location, or, where permitted under the AAA’s rules, remotely or based on written submissions. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
16.4 Class Action Waiver. Any arbitration or proceeding under these Terms will be conducted only on an individual basis, not as a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request will proceed in court, while the remainder of this arbitration provision remains in effect.
16.5 Small Claims Exception. Notwithstanding Section 16.3, either party may bring an individual claim in small claims court in a jurisdiction with proper jurisdiction over the claim, so long as the claim qualifies for that court.
16.6 Venue for Non-Arbitrable Matters. For any matter not subject to arbitration (such as a request for injunctive relief to protect intellectual property, or a small claims action), you and Nurse Well Versed consent to the exclusive jurisdiction and venue of the state and federal courts located in New Jersey.
17. Changes to Terms
We reserve the right, in our sole discretion, to modify these Terms at any time. If we make material changes, we will update the “Effective Date” below and, where appropriate, provide additional notice, such as a banner on the Site or an email. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms supersede all prior versions of our Terms & Conditions as of the Effective Date above. Any transaction or use of the Services occurring before the Effective Date remains governed by the version of the Terms in effect at that time.
